Dr. Littman speaks on the legal battle between TV star Sofia Vergara and her ex-fiancé, Nick Loeb, over custody of their frozen embryos the couple created in 2013 when they were still together.
Loeb is hoping to gain control over the embryos and wants a surrogate to carry the embryos to term, but a contract the couple signed states that embryos could only be brought to term with both party’s consent.
Dr. Littman discusses the legalities of the situation on FOX5 Vegas citing the case of Roman vs Roman which set a precedent upholding the terms of a contract regarding the disposition of frozen embryos in the event of divorce.
Dr. Littman advises to explore the option of freezing eggs if there is any question of the longevity of your relationship. This gives a lot of freedom to only create and store embryos that will be used, rather than having to discard them in the event of separation.
